For example, if one of the parties commits adultery in another state or country you may still file in Maryland as long as one of the parties is a Maryland resident. Effective Oct.1,2015, If there are no children and you have a valid separation agreement you may file for divorce without waiting on the basis of no fault. However, you must still be a resident of Maryland. Military personnel that treats Maryland as their home state may file in Maryland even stationed out of the state. If the ground for divorce occurred in Maryland, you only need currently live in Maryland at the time you file for divorce. So if you then move after the filing then Maryland Court can still grant the divorce if the allegations of divorce are proved.
